By creating an account or using formulaPRO Lab ("the App," "we," "our," "us"), you agree to be bound by these Terms of Use. If you do not agree, do not create an account or use the App.
formulaPRO Lab is a cloud-based color formula management application that allows users to log, store, search, and share paint and stain color formulas. The App includes AI-powered label extraction from photos, customer and branch management, SMS notifications, an AI troubleshooting assistant, and subscription-based access tiers. The service is provided on a monthly subscription basis with different feature limits per plan.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Access to formula data is restricted to authenticated users within the same company organization. You agree not to share your login credentials or attempt to access data belonging to other companies. You must provide accurate information when creating your account and keep it updated.
You agree to use the App only for lawful purposes. You will not: (a) upload or store content that is unlawful, infringing, defamatory, or otherwise objectionable; (b) attempt to access data or features you are not authorized to access; (c) use the App to store any content that infringes the intellectual property rights of others; (d) reverse engineer, decompile, or attempt to extract the source code of the App; or (e) use the App in any way that could damage, disable, or impair the service.
You retain ownership of all formula data, images, customer records, and other content you create or upload to the App. By using the App, you grant formulaPRO Lab a limited, non-exclusive license to store, process, and display your content solely for the purpose of operating the App features you requested. This license is limited to providing the service and does not grant us any right to use your content for other purposes.
You are solely responsible for the content you upload to the App. You represent and warrant that you have the right to upload any images, data, or content you submit, and that doing so does not violate any law or the rights of any third party. We reserve the right to remove any content that we believe violates these Terms or applicable law.
formulaPRO Lab is an organizational and logging tool. The App captures formula data as provided by you or extracted by AI from uploaded images. We make no warranty, express or implied, regarding the accuracy, completeness, or fitness for purpose of any color formula, colorant weight, or calculation stored in or produced by the App. Formulas extracted via AI scanning should always be verified by a qualified specialist before use.
The App is not a substitute for professional laboratory, engineering, medical, or manufacturing advice. Any calculations, conversions, or AI-generated recommendations provided by the App are for informational purposes only. formulaPRO Lab is not responsible for color mismatches, production errors, material waste, or financial loss resulting from the use of formula data or AI-generated content from the App.
formulaPRO Lab provides formula storage as a convenience tool. We are not liable for any loss, corruption, or inaccessibility of color formula data, customer records, job information, or any other data stored in the App, whether caused by technical failure, user error, account termination, subscription lapse, or any other reason. You are solely responsible for maintaining backup records of any business-critical formula or customer data.
formulaPRO Lab is a paid subscription service. Subscription fees are billed monthly and are non-refundable except as required by law. We reserve the right to modify pricing with reasonable advance notice. Failure to maintain an active subscription may result in restricted or suspended access to stored data. Optional add-on purchases, such as extra monthly uploads, are billed as part of your recurring subscription.
The formulaPRO Lab platform, interface, and underlying software are proprietary. You retain ownership of the content you enter, as described in Section 5. The App name, logo, and branding are the property of the app owner.
To the fullest extent permitted by applicable law, formulaPRO Lab and its developers, officers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the App, including but not limited to loss of data, loss of revenue, loss of business opportunity, or damage to reputation. Our total aggregate liability shall not exceed the amount paid by you in the three (3) months preceding the claim.
You agree to indemnify and hold harmless formulaPRO Lab and its team from any claims, losses, damages, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any conduct we deem harmful to the platform or other users. You may delete your account at any time through the Profile page. Upon termination, your access to stored data may be revoked.
These Terms shall be governed by and construed in accordance with the laws of [Governing State/Jurisdiction — to be updated by the app owner], without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in [Governing Jurisdiction — to be updated by the app owner].
We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
